Quilt2Go Beta Program Terms and Conditions

PLEASE READ THIS DOCUMENT CAREFULLY BEFORE REGISTERING FOR THE QUILT2GO BETA PROGRAM. PARTICIPATION IN THE BETA PROGRAM INDICATES THAT YOU ACCEPT THESE TERMS AND CONDITIONS. IF YOU DO NOT ACCEPT THESE TERMS AND CONDITIONS, DO NOT REGISTER FOR THE BETA PROGRAM.

Introduction: The Quilt2Go Beta Program ("the Beta Program") is offered to individuals who wish to assist in testing prerelease versions of products developed by Quilt2Go and Paul Mietz Egli. The Beta Program is open-ended, but may be terminated at any time by you or Quilt2Go for any reason. To end your involvement with the Beta Program, you must send an email message to support@quilt2go.com indicating that you wish to no longer participate.

1. Participant Feedback: By participating in the beta program, you agree to provide feedback to Quilt2Go developers about your experience using software, web sites, documentation, and promotional materials that are provided by Quilt2Go. All of your feedback, suggestions, and comments as well as any log files, crash reports, or other supporting information shall be the property of Quilt2Go and may be used for any purpose.

2. Confidential Nature of the Program: You acknowledge and agree that the materials provided to you under the Beta Program are confidential. These materials are pre-release versions which are not intended for public disclosure or distribution. You agree that you will not distribute any materials provided to you as part of the Beta Program.

3. Participant's Warrants and Representations: You warrant and represent that you:

  1. are at least 18 years of age
  2. own all of the hardware you will use for testing and do not share it with anyone outside of your immediate family
  3. will continue to have access to the Internet through an Internet service provider ("ISP") for the duration of the Beta Program
  4. will not disclose any of the materials distributed under the Beta Program to any third party, including but not limited to any trade or consumer press, news agency or any competitor of Quilt2Go

5. LIMITATION OF LIABILITY AND REMEDIES: You agree that notwithstanding any damages that you might incur for any reason whatsoever (including, without limitation, all direct or general damages), Quilt2Go, Paul Mietz Egli, and any of their affiliates will not be held responsible. The foregoing limitations, exclusions and disclaimers shall apply to the maximum extent permitted by applicable law, even if any remedy fails of its essential purpose. In no event shall Quilt2Go, Paul Mietz Egli, or their affiliates be liable for any special, incidental, indirect, or consequential damages whatsoever.

Materials provided under the Beta Program may not be fully functional and may result in data loss. Quilt2Go and Paul Mietz Egli are not responsible for and cannot guarantee proper functionality of applications provided under the Beta Program nor can they guarantee accuracy of documentation or other written materials.

6. Term/Termination: This Agreement will be effective from the time you receive an email confirmation of your acceptance into the Beta Program. You may terminate this Participation Agreement at any time by providing written notification of your termination via email to support@quilt2go.com. Your account and participation privileges may be terminated immediately if you fail to comply with any of the terms and conditions of this Agreement or if you fail to provide reasonable feedback in a timely manner. Quilt2Go and Paul Mietz Egli also reserve the right to terminate your account or the Beta Program at any time with or without cause.

NO WARRANTY: SERVICES ARE PROVIDED "AS IS" AND, TO THE MAXIMUM EXTENT PROVIDED UNDER LAW, QUILT2GO AND PAUL MIETZ EGLI DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE. WITHOUT LIMITING THE FOREGOING, QUILT2GO AND PAUL MIETZ EGLI DO NOT GUARANTEE THAT YOU WILL BE ABLE TO CONTINUE TO USE ANY MATERIALS PROVIDED UNDER THE BETA PROGRAM AT ANY TIME YOU WANT.
